1. Return/Refund Application
1.1 Subject to the terms and conditions of this Refund and Return Policy and the Terms of Service, Buyer may request the return of purchased merchandise ("Items") and/or a refund before the expiration of NewEgg's warranty period. Terms of Service.
1.2 NewEgg Guarantee is a service provided by NewEgg at the request of users, aiming to assist users in dealing with certain conflicts that may arise during the transaction process. Users can communicate with each other privately to resolve differences before, during or after using NewEgg Guarantee, or contact relevant local authorities to assist in resolving any disputes.
2. Return application
2.1 The Buyer may apply for a refund and/or return of goods only under the following circumstances:
The buyer has not received the item;
The item is defective and/or damaged upon delivery;
The item received is incomplete (missing quantity or accessories);
The goods delivered by the seller to the buyer do not conform to the agreed specifications (such as errors in size, color, etc.);
The items delivered to Buyer differ materially from the description provided by Seller in the item listing;
The item received was counterfeit**;
Items received with physical damage (e.g. dented, scratched, broken);
Items received are defective (e.g. malfunctioning, not working as expected);
By entering into a private agreement with the seller, the seller must send a confirmation letter to NewEgg to confirm the agreement; or

*Change of mind return policy only applies to certain categories and to certain sellers.
**Counterfeit goods return policy only applies to NewEgg Mall sellers.
2.2 Buyer's application must be submitted through the NewEgg mobile application.
2.3 NewEgg will review each buyer's application on a case-by-case basis and determine, at its sole discretion, whether the buyer's application is successful.
2.4 Please note that if requested by NewEgg, the Buyer must ship the goods to a location designated by NewEgg within ten (10) calendar days of making the return request.
2.5 NewEgg will decide at its sole discretion whether to approve your refund and return request. Buyer acknowledges and agrees that NewEgg's decision is final, conclusive and binding, and undertakes and agrees that it will not litigate or otherwise assert any claim against NewEgg or its affiliates with respect to such decision.
2.6 If the Buyer has initiated legal proceedings against the Seller, the Buyer may provide NewEgg with a formal notice from the relevant authorities requiring NewEgg to continue to hold the purchase money until a formal decision is made. NewEgg will determine at its sole discretion whether it is necessary to continue to hold such purchase funds.
3. Right of priority seller
3.1 If you are a Preferred Seller, you should have received separate written notification from NewEgg of your election to participate in the NewEgg Preferred Seller Program. If you decide at any time not to participate in the NewEgg Preferred Seller Program, please notify NewEgg in writing; otherwise, you will be deemed to have chosen to continue participating in the NewEgg Preferred Seller Program and to have agreed to the terms and conditions set forth in this Refund and Return Policy. NewEgg may suspend or remove any Preferred Seller from the NewEgg Preferred Seller Program at any time in its sole discretion.
3.2 NewEgg’s decision to approve a refund or return in accordance with clause 2 above shall be binding on the relevant Preferred Seller. Preferred Sellers agree to comply with and take all necessary steps to implement Buyer's refund or return requests approved by NewEgg.
3.3 For any refund or return request approved by NewEgg, NewEgg will notify the Preferred Seller by email ("Email Notification") and organize the delivery of the relevant Returned Items to the address provided to NewEgg in writing by the relevant Preferred Seller. Complete the refund and return process as long as the address is located in the country listed on the Site for sale of the relevant products (the "Local Address"). If the Preferred Seller fails to provide a local address for return of the returned item, or fails to accept delivery of the returned item within a reasonable period (as determined by NewEgg), NewEgg reserves the right to dispose of the item in any manner it deems appropriate, and the Preferred Seller shall is deemed to be a waiver of all rights to the goods. If a Returned Item is not received by the Preferred Seller, the Preferred Seller must notify NewEgg within seven (7) days of receipt of the email notification (the "Notification Period"). Failure to notify NewEgg within the notice period will be conclusive evidence and result in acceptance by the Preferred Seller
